The everywhere Programme

The use of any Card / Vouchers / Electronic promotion code issued by Creative Power (S) Pte Ltd (hereinafter referred to as "CPS") under the everywhere program to any person who has applied for the same constitutes acceptance of the terms and conditions listed below.

1. The everywhere Card / Vouchers / Electronic promotion code (hereinafter referred to as "eYW") is a member identification pass.  The eYW is issued for use solely by the member, and shall not be assigned or transferred under any circumstances.
   
   
2. The eYW is the sole and exclusive property of CPS and it may be revoked and cancelled anytime without prior notice and may at any time require the member to return any eYW for non-compliance with these terms and conditions. In the event that any member is revoked or cancelled for any reason, CPS reserves the right to cancel all points earned in relation to that member's account and/or refuse the member to make any redemption with the accrued points.
   
   
3. Lost Of eYW
• Creative Power (S) Pte Ltd (CPS) shall not be under any obligation to replace any eYW which have been misplaced, lost, damaged or stolen.
• Lost or stolen eYW should be reported immediately in writing to CPS. In the case where the eYW is a Card, a replacement card will be provided to the registered member upon verification of identification and other details as may be required by CPS. Members are required to pay S$5.00 for each replacement Card.
• CPS will not be responsible for any delay in replacing a lost or stolen eYW, for unauthorized use of eYW, for delayed or lost correspondence, whether in the mail or otherwise or for any loss arising from the same.
  
  
4. Changes
• Members are responsible for informing CPS any change in personal particulars at the first reasonable opportunity after such change.
  
  
5. The member shall abide by the following in using the eYW:
• The member shall present the eYW BEFORE or upon making any purchase from our Participating Merchant.
• All relevant taxes (including GST) or service charges incurred in all transactions involving the presentation of the eYW shall be borne by the member.
• Each Participating Merchant has the absolute discretion to reject the eYW, if it has reasonable grounds to suspect, or there has been any report that the eYW has been tempered with, whether intentional or not.
  
  
6. All staff members of CPS and their immediate families shall not be eligible for the lucky draws under the everywhere program but shall be eligible for all other privileges and benefits under the everywhere program.
   
   
7. CPS may at its absolute discretion, disclose to any third parties details of any information in its possession or control relating to the member.
   
   
8. The list of Participating Merchant and OFFERS* available to our members may be revised from time to time by CPS as it deems fit (* OFFERS refer to such promotions and/or discounts and/or other benefits specially for members ).
   
   
9. Whilst every reasonable endeavour will be made by CPS to ensure that Offers shall be made available by the Participating Merchants, CPS shall not be liable in any way and no member shall have any claims whatsoever against CPS if the eYW is not accepted or honoured by a Participating Merchant, whether or not due to CPS's failure or refusal to authorize the award of everywhere points (known as WORD), or any other benefits under the everywhere program.
   
   
10. CPS shall not be liable for any loss, physical injury, illness, costs or damages resulting from or during any visit or purchases made from any Participating Merchant.
    
    
11. CPS, its directors, staff, agencies, consultants or associates shall not be liable to any member in respect of any issues concerning the issuance of the eYW and the operation and maintenance of the everywhere program.
    
    
12. CPS shall not be liable for any defect or deficiency in the goods purchased or services rendered by a Participating Merchant. Any claim by a member against, or dispute between a member with any Participating Merchant or any other party shall be settled between the member and such parties, without reference to CPS, and CPS shall not be affected by nor be obliged in any way to be involved in any such dispute. No claim by any member against any Participating Merchant or third party shall be subject of a claim / defense or counterclaim against CPS.
    
    
13. The member shall not hold CPS liable for any loss or damaged if CPS is not able to perform its obligations under this Agreement due(directly or indirectly) to the failure of any machine, data processing system or transmission link, or civil or industrial dispute, or as a consequences of any fraud or forgery, ACT of GOD or due to any other event beyond the reasonable control of CPS.
    
    
14. If anyone or more of the provisions of this agreement or any part thereof shall be declared or adjudged to be illegal, invalid or unenforceable under any applicable law, such illegality, invalid or unenforceability shall not vitiate any other provisions of this Agreement which shall remain in full force and effect.
    
    
15. CPS reserves the right to terminate the programme at any time. Notice of such termination will be sent to members at their email addresses or addresses as set out in CPS records. Members will have 90 days beyond the date of such notice to make redemption. All WORD remaining unredeemed at the end of this 90 days period will be cancelled and in respect become void and may not be redeemed and shall not be entitled to any compensation in respect thereof.
    
    
16. CPS shall have the right to amend, modify or supplement the terms and conditions herein, including those relating to the withdrawal or addition of Offers, as it deems fit from time to time, without any prior notice to the member.
    
    
17. CPS is the final authority as to the interpretation of these terms and conditions and as to any other questions or disputes regarding the program.
    
    
18. Any notice, communications summary or other Program materials which we send you in connection with the Program and/or these Terms and Conditions will be sent via email or regular mail to your mailing address according to our records and will be deemed effective when emailed or sent. Any notice or communication to CPS shall only be effective upon actual receipt by CPS.
    
    
19. This agreement shall be governed by and construed in accordance with the laws of Singapore.
